THE DALLAS PARTY TERMS OF SERVICE

Welcome. By using thedallasparty.com ("Site"), you agree to these Terms of Service ("Terms"). If you don't agree, please don't use the Site.

1. Who We Are

The Dallas Party is a party rental company based in Dallas-Fort Worth, Texas. We rent modern white bounce houses, party gear, and supplies. We don't plan or run events. The host runs the party. We bring the gear.

2. Eligibility

You must be at least 18 years old to use this Site to book a rental. By using the Site to make a booking, you represent that you are 18 or older and have the legal authority to enter into this Agreement.

3. The Site vs. the Rental

These Terms govern your use of the Site only. The rental of equipment is governed by a separate Rental Agreement that you'll sign when you book. The Rental Agreement covers everything related to the actual rental: payment, cancellation, weather, equipment use, damages, and liability. These Terms cover everything else.

4. Booking Through the Site

Submitting a booking request through the Site doesn't guarantee availability. We confirm bookings by email after we check the calendar. Your booking is final once you've signed our Rental Agreement and paid the deposit.

5. Accuracy of Information

We work to keep inventory, pricing, and availability accurate. Sometimes errors happen. If something on the Site is wrong (a price, an availability date, a product description), we'll let you know before your booking is finalized and we won't be bound by the error. We reserve the right to correct errors and to update Site content at any time without notice.

6. Account Information

If you create an account on the Site, you're responsible for keeping your login credentials secure and for any activity under your account. Let us know immediately if you suspect unauthorized access.

7. Acceptable Use

When using the Site, you agree not to:

• Copy, reproduce, or distribute Site content without written permission
• Scrape, mine, or extract data from the Site by any automated means
• Attempt to gain unauthorized access to the Site, our systems, or other users' accounts
• Interfere with the Site's operation or security
• Use the Site to transmit viruses, malware, or harmful code
• Use the Site for any unlawful purpose or to violate anyone's rights
• Submit false, misleading, or fraudulent information

8. Intellectual Property

All content on the Site (photos, copy, designs, logos, brand elements) belongs to The Dallas Party and is protected under U.S. and international copyright, trademark, and other intellectual property laws.

If you'd like to use any of it (a press feature, a blog mention, a partnership), email hello@thedallasparty.com and we'll usually say yes.

Reproducing, copying, or distributing any of it without written permission isn't allowed.

9. User Content

If you submit reviews, photos, comments, or other content to the Site, you grant The Dallas Party a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with our business and marketing. You represent that you own or have permission to share any content you submit.

10. Third-Party Links

The Site may link to third-party websites (vendors, partners, social media). We're not responsible for the content, privacy practices, or terms of those sites. Visiting them is at your own risk.

11. Site Availability

We do our best to keep the Site running, but we don't guarantee it'll be available 100% of the time or free from errors, bugs, or interruptions. We may modify, suspend, or discontinue any part of the Site at any time.

12. Disclaimers

THE SITE AND ALL CONTENT, MATERIALS, AND SERVICES PROVIDED ON OR THROUGH THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF INFORMATION.

The Dallas Party does not warrant that the Site will be uninterrupted, error-free, or free of viruses or harmful components. We do not warrant the accuracy, completeness, or reliability of any content on the Site. Statements made on the Site about products, services, or experiences are descriptive and not guarantees.

Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE DALLAS PARTY, ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR LOST OPPORTUNITIES, EVEN IF THE DALLAS PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event will The Dallas Party's total liability to you for all claims arising out of or related to your use of the Site exceed the greater of (a) the amount you paid to The Dallas Party in the six (6) months preceding the claim, or (b) one hundred dollars ($100).

This Limitation of Liability does not apply to liability arising from the rental of equipment, which is governed by the separate Rental Agreement.

14. Indemnification

You agree to defend, indemnify, and hold harmless The Dallas Party, its owners, employees, and contractors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of or related to (a) your use of the Site, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) any content you submit to the Site.

The Dallas Party reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.

15. Dispute Resolution

Any dispute, claim, or controversy arising out of or related to these Terms or your use of the Site will be resolved through informal negotiation first. If the dispute cannot be resolved informally within thirty (30) days, the parties agree that any unresolved dispute will be brought exclusively in a state or federal court located in Dallas County or Tarrant County, Texas, and both parties consent to personal jurisdiction in those courts.

You and The Dallas Party agree that any dispute will be brought on an individual basis only, and not as a plaintiff or class member in any class, collective, or representative action. You waive any right to participate in class action proceedings.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute not subject to arbitration will be brought exclusively in a state or federal court located in Dallas County or Tarrant County, Texas. You consent to personal jurisdiction in those courts.

17. Termination

We may suspend or terminate your access to the Site at any time, for any reason, without notice. The sections of these Terms that by their nature should survive termination (intellectual property, indemnification, limitation of liability, dispute resolution, governing law) will survive.

18. Changes to These Terms

We may update these Terms occasionally. The "last updated" date at the top will tell you when. For material changes that affect your rights, we'll provide notice on the Site or by email to active customers. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

19. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable.

20. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, Weather Policy, Copyright Notice, and (for booking customers) the Rental Agreement, constitute the entire agreement between you and The Dallas Party regarding your use of the Site.
